TERMS & CONDITIONS
Please review the following Terms & Conditions carefully before placing your order. By submitting payment, signing this Agreement, or otherwise engaging the services of Sweet Pea Cakery LA, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Sweet Pea Cakery LA reserves the right to decline or cancel an order at its discretion when necessary. All cake designs, sketches, photographs, and related creative materials remain the intellectual property of Sweet Pea Cakery LA unless otherwise agreed in writing.
Confirmation of Order
Please review your Agreement and invoice carefully to ensure all information is accurate, including contact information, spelling of names, event details, design selections, flavors, delivery information, and guest count. Any discrepancies or requested changes should be communicated promptly in writing.
Reservation & Payment
A non-refundable reservation fee equal to 50% of the total order is required to secure your event date and will be applied toward the total balance.
An order is not considered confirmed until both the signed Agreement and reservation fee have been received.
The remaining balance, final guest count, flavor selections, delivery details, and any applicable adjustments are due no later than three (3) weeks prior to the event date unless otherwise stated in writing.
Failure to submit payment by the due date may result in cancellation of the order, forfeiture of the reservation fee, and release of the event date without further notice.
Design Changes
Design revisions may be requested up to thirty (30) days before the event date. While every effort will be made to accommodate revisions, changes requested after this deadline cannot be guaranteed.
Any changes that affect the design, guest count, materials, labor, or decorative elements may result in a revised proposal and additional charges.
Cancellation & Rescheduling
All cancellations and rescheduling requests must be submitted in writing. Reservation fees are non-refundable.
If your event must be rescheduled, Sweet Pea Cakery LA will make every reasonable effort to accommodate a new date based on availability. Additional charges may apply if products or decorative elements must be remade.
Orders cancelled within ten (10) days of the scheduled event remain responsible for the full contract balance, as ingredients, scheduling, and production have already been committed.
TASTINGS
Cake tastings and consultations are available by appointment only. Tasting boxes must be picked up during the scheduled appointment window. Missed pickups may result in forfeiture without refund.
Appointments cancelled or rescheduled with at least seventy-two (72) hours' notice may be transferred to a future available date. Cancellations made with less than 72 hours' notice and no-shows are non-refundable.
Authorized Changes
Only the Client(s) listed on the Agreement or their designated event planner may authorize changes to the order. Requests from family members, friends, or other third parties cannot be accepted unless written authorization has been provided by the Client.
Serving Sizes
Serving quantities are based on the industry-standard wedding slice measuring approximately 1" × 2" × cake height. Coffee-sized servings measuring approximately 1" × 1" × cake height are available upon request.
Sweet Pea Cakery LA is not responsible for shortages resulting from inaccurate guest counts or cakes being cut into larger-than-recommended portions.
Artistic Style
By placing an order, the Client acknowledges that they have reviewed Sweet Pea Cakery LA's portfolio and selected our services based on the artistic style, quality, and aesthetic represented in our body of work. Unless otherwise specified in this Agreement, the finished cake will reflect Sweet Pea Cakery LA's signature design style and creative approach.
Reference photographs are welcomed as inspiration; however, each cake is custom designed for the individual celebration. Sweet Pea Cakery LA does not replicate another artist's work and reserves full artistic discretion in interpreting inspiration images, including color, proportion, texture, decorative techniques, and overall composition.
Non-Edible Decorations
Certain decorative elements are intended solely for display and must be removed before serving. These may include, but are not limited to, floral tape, wires, dowels, supports, rice paper sails, wafer decorations, faux spheres, toy toppers, acrylic or wooden cake toppers, and sugar flowers reinforced with wire.
Although some decorations are created from edible materials, they may contain non-edible structural components and should not be consumed.
Fresh Florals
If fresh flowers are to be incorporated into the cake design, they are to be supplied by the Client or florist unless otherwise agreed upon.
Sweet Pea Cakery LA is happy to coordinate directly with your florist to ensure appropriate flowers are reserved for the cake.
Fresh flowers are not food products and may contain dirt, insects, pesticides, herbicides, or other contaminants. By choosing fresh florals, the Client acknowledges these inherent risks.
Sweet Pea Cakery LA is not responsible for the quality, freshness, condition, safety, or cleanliness of flowers supplied by others and reserves the right to decline the use of any botanical deemed unsuitable for food presentation.
Cake flowers should be clearly set aside at the venue before delivery. If they cannot be located upon arrival, Sweet Pea Cakery LA reserves the right to complete setup without them.
Storage & Care
Buttercream cakes are highly perishable and should remain refrigerated or in an air-conditioned environment below 75°F until display.
Avoid direct sunlight, excessive humidity, outdoor exposure, or placement near heat sources.
Failure to follow these recommendations may result in melting, cracking, color bleeding, condensation, or structural instability, for which Sweet Pea Cakery LA cannot be held responsible.
Delivery & Setup
Delivery & Setup by Sweet Pea Cakery LA
We deliver, assemble, and style the cake in its final display location. Once the cake has been accepted by the Client, planner, venue representative, or designated recipient, responsibility for the cake transfers to the Client.
Venue or Client Relocation After Delivery
If the Client requests early delivery or requests that the cake be refrigerated until display, the Client and/or venue assumes full responsibility for storing, transporting, relocating, and displaying the cake. This includes moving the cake from refrigeration, protecting it from sunlight or excessive heat, and ensuring it is placed on a stable, level surface. Sweet Pea Cakery LA is not responsible for damage occurring after the cake has been relocated or handled by anyone other than our team.
Client Pickup
Clients who elect to pick up their order assume full responsibility for the cake once it leaves the Sweet Pea Cakery LA studio. Sweet Pea Cakery LA assumes no responsibility for damage resulting from transportation, handling, setup, storage, or environmental conditions after pickup. Due to the delicate nature of stacked cakes, professional delivery is strongly recommended for all multi-tier cakes.
Outdoor Display
Buttercream cakes are sensitive to environmental conditions including heat, wind, humidity, uneven surfaces, insects, wildlife, and direct sunlight.
Sweet Pea Cakery LA cannot guarantee the condition or longevity of products displayed outdoors or in uncontrolled environments after delivery.
Allergens & Dietary Information
Our cakes are made with carefully selected ingredients in a kitchen that also handles common allergens, including dairy, eggs, wheat, soy, sesame, peanuts, and tree nuts.
While every reasonable precaution is taken, cross-contact cannot be guaranteed.
It is the Client's responsibility to inform guests of any food allergies or dietary concerns. Sweet Pea Cakery LA shall not be liable for allergic reactions or dietary sensitivities.
Refund Policy
Due to the custom nature of our products, all sales are final.
If there is a concern regarding quality or workmanship, Sweet Pea Cakery LA must be notified within twenty-four (24) hours of delivery or pickup.
The remaining product must be preserved and returned upon request to allow for evaluation. Failure to retain the product may void any consideration of compensation.
Photography & Marketing
Sweet Pea Cakery LA reserves the right to photograph all cakes and dessert displays before, during, or after delivery for use in portfolios, social media, advertising, editorial publications, printed materials, and our website.
We may also obtain and use professional photographs from photographers, planners, venues, or other vendors involved with the event.
Due to the nature of events, Sweet Pea Cakery LA is not responsible for changes made to the cake or display by the Client, guests, venue staff, or other vendors after setup.
Clients requesting complete privacy must notify Sweet Pea Cakery LA in writing prior to the event. We will gladly honor reasonable privacy requests whenever possible.
Privacy
Sweet Pea Cakery LA respects your privacy and will never sell, share, or distribute your personal information except as required by law or with your written authorization.
Acceptance of Terms
By submitting payment and entering into an Agreement with Sweet Pea Cakery LA, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions in their entirety.
